On October 6, 2023, a New York appeals court made a major decision concerning former U.S. President Donald Trump and his real estate empire. The decision pauses the enforcement of a September order by Justice Arthur Engoron calling for Trump and his family business to strip away companies that control key assets, including Trump Tower, improvements on 40 Wall Street, and other buildings.
The decision comes in response to an ongoing civil fraud case launched by New York Attorney General Letitia James and comes as a ray of hope to Trump, who has denied all accusations of fraud while calling the case a political witch hunt. Furthermore, this court ruling does not necessarily indicate how they may decide upon the case’s appeal, which could take over a year and would solidify Trump’s assets.

Judge Engoron’s order erroneously sought to adjudicate the rights of non-party business entities that employ nearly 1,000 hard-working New Yorkers, have never been accused of any wrongdoing and, were never given their day in court – in clear violation of their fundamental Constitutional rights and Due Process. We will continue to vigorously defend our company and our incredible employees from this politically-motivated persecution.”

In a statement after the decision Trump lawyer Christopher Kise said: “We are very pleased the First Department upheld New York law and put a halt to any cancellation of business certificates, receivers or dissolution. The trial court’s attempt to reach issues, entities and assets beyond the scope of this case has been suspended.”
The trial is set to resume on Tuesday.
