Judge Dismisses Lawsuit Against Fox News

You may remember Nina Jankowicz.

She was designated by the Biden administration to lead a disinformation board in 2021.

Nina didn’t last long.

However, Jankowicz was in the news a while back announcing that she lodged a lawsuit alleging 37 distinct false and defamatory statements about her, a form of “disinformation” against Fox News. However, a federal judge ended up dismissing the case, and here’s why: Jankowicz’s accusations proved to be somewhat “disinformation-y” themselves.

Jankowicz claimed that these defamatory remarks led to waves of online attacks and violence threats against her. This all originated after the establishment of the Disinformation Governance Board, where she served as a director. Yet, in the wake of the board’s operations being paused, Jankowicz resigned just weeks following its inception after immense public backlash.

Judge Colm F. Connolly dismissed Jankowicz’s claims, noting that 36 of the 37 statements were about the disinformation board and not Jankowicz herself. The single remaining statement, which included an image of Jankowicz, was not deemed disinformation as it accurately described the board’s purpose—as outlined in its own charter.

Furthermore, the so-called false statements that Jankowicz argued were found to be “substantially true.” The judge further clarified that Jankowicz failed to produce any plausible facts that would suggest the statements made about her intended censorship were false. On the contrary, the Disinformation Governance Board was precisely established to pinpoint “misinformation,” “disinformation,” and “malinformation,” a mission which could be fairly viewed as a form of censorship.

Adding a fun layer of irony to the story, Jankowicz, who once held the title of Disinformation Czar, has been discovered to be engaging in… you guessed it, disinformation.
